1Scope, and relationship to Apple's Standard EULA
These Terms of Service ("these Terms") apply to the Linkalyst application for iOS and iPadOS, including its widgets and Live Activity (together, "the App"), published by Entromoonic Ltd ("we", "us", "our"), a company incorporated in Delaware, United States.
The App is licensed to you under Apple's Standard End User Licence Agreement, which you accept upon obtaining the App from the App Store. These Terms supplement that agreement and do not replace it. Where these Terms conflict with Apple's Standard End User Licence Agreement, that agreement prevails.
These Terms govern the conditions under which the App's measurement tools may be used, as set out in section 4, and the status of the results they produce, as set out in section 6.
Downloading or using the App constitutes acceptance of these Terms. If you do not accept them, do not use the App.
2The Application
The App is a network measurement toolkit for iPhone and iPad running iOS or iPadOS 17.0 or later. It provides latency measurement (ICMP and UDP), port connection tests, DNS queries and records, resolver comparison, website checks including TLS certificate details, local network service discovery, throughput measurement, file download measurement, route tracing, gateway information, offline CIDR calculation, comparison of saved reports, import and export of reports, optional IP address information, and optional iCloud synchronisation of reports.
The App operates no account system, requires no registration, and has no server operated by us. Test reports are stored on your device and are not transmitted to us.
3Licence
Subject to these Terms and to Apple's Standard End User Licence Agreement, you are granted a limited, non-exclusive, non-transferable licence to use the App for personal or internal business purposes on Apple-branded devices that you own or control, in accordance with the App Store Usage Rules. Family Sharing is supported where Apple makes it available.
Except to the extent that applicable law expressly permits, you may not reverse engineer, decompile or disassemble the App, nor redistribute, rent, lease, sublicense or resell it.
4Acceptable use
4.1 Authorised targets
The App's measurement tools may be used only against networks, hosts, addresses and services that you own, or for which you have obtained explicit authorisation from the party responsible for them. On a corporate, institutional or educational network, the administrator's consent is required before use.
4.2 Prohibited uses
The App may not be used to:
- 1.perform stress testing or any denial-of-service activity against systems that are not your own;
- 2.probe, scan or enumerate networks, hosts or services that are neither your own nor within the scope of an authorisation granted to you;
- 3.circumvent access controls, authentication or security measures;
- 4.act in breach of the terms of service or acceptable use policy of the party operating a target; or
- 5.carry out any unlawful purpose.
4.3 Nature of the traffic generated
The App generates genuine network traffic to the targets specified by the user, comprising ICMP and UDP probes, TCP connections, HTTP and HTTPS requests, DNS queries, and local network service discovery. Firewalls, intrusion detection systems and network operators may classify such traffic as suspicious and may log, block, rate-limit or report it. The consequences of such classification are borne by the user.
4.4 Data volume and charges
Throughput and download measurements transfer up to 64 MiB in a single run, subject to a ten-second limit. A website check makes five requests one second apart; performed with GET, each reads up to 256 KiB of the response body. Route tracing sends up to three probes for each of up to thirty hops. Where such measurements are performed over a cellular connection, any data charges applied by your carrier are borne by you.
4.5 Responsibility
You are responsible for your use of the App. To the extent permitted by applicable law, and without limiting any right of yours that may not lawfully be restricted, you are responsible for third-party claims arising from use of the App in breach of this section 4. This paragraph does not limit the statutory rights of a consumer where local law does not permit such limitation.
5Self-hosted test peers
Two tools require an endpoint operated by the user: the UDP echo test peer and the TCP throughput test peer. Neither peer forms part of the App. The Python programs are obtained from our website, and are provided as is.
Deployment of those endpoints, their security, the extent to which they are exposed, and their shutdown after use are the responsibility of the user. Both peers transmit in plain text and neither applies encryption, and they are to be run on a private network only; their ports are not to be forwarded from the Internet. The access code printed by the UDP echo peer is held in memory only, is never written to a report, and constitutes a simple check rather than encryption; it does not protect the contents of the traffic. The throughput peer uses no access code.
6Measurement results
6.1 Nature of the results
Latency, timeouts, packet loss, latency variation, routes, throughput, download rates, DNS answers and TLS certificate information are each affected by the state of the device, system scheduling, the wireless environment, intermediate network equipment, and the policies of the party operating the target. Results are provided for reference and are not warranted to be accurate, complete or reproducible.
6.2 Specific limitations
- 1.A timeout indicates that no reply was received within the configured period. It does not establish that a link has failed.
- 2.A hop returning no reply during route tracing ordinarily indicates equipment configured not to answer ICMP. It does not establish that the path is broken.
- 3.Throughput results reflect a single connection, a bounded synthetic payload, and the particular test peer and path used. They do not represent the capacity of a wireless link or the bandwidth supplied by a carrier.
- 4.Latency variation is the mean difference between adjacent on-time replies. It is neither RTP jitter as defined in RFC 3550 nor a measurement of one-way delay variation.
- 5.The Wi-Fi network name and access point identifier are supplied by the operating system and refresh at intervals of approximately five seconds. Changes of shorter duration may not be recorded.
6.3 Evidentiary status
Results produced by the App do not constitute grounds for a claim against a carrier or service provider, a basis for the acceptance or rejection of a service level agreement, legal evidence, or professional advice of any kind.
7IP address information and third-party data
Where the optional IP address lookup is enabled, the region, network organisation and ASN are obtained from FreeIPAPI. That information is reference data concerning an address and may be out of date or inaccurate. The region is the database's reference attribution rather than the precise location of a device or server, and the network organisation is the owner of the ASN, which may differ from the access provider.
Those results incorporate data from DB-IP (https://db-ip.com/), made available under the Creative Commons Attribution 4.0 International licence (https://creativecommons.org/licenses/by/4.0/). That attribution is preserved in the App.
8Purchases
"Remove Ads" is a one-time, non-consumable in-app purchase that hides banner advertising. It does not unlock, restrict or alter any other function of the App. Family Sharing is supported, and the purchase may be restored on another device signed in to the same Apple Account.
The price displayed by the App Store at the time of purchase applies. Payment, billing and refunds are administered entirely by Apple under Apple's own policies; we do not process payments and cannot issue refunds. Refund requests are made to Apple at https://support.apple.com/billing
9Advertising
The App displays a single banner advertisement at the foot of its three principal pages. No advertisement is displayed during the first three days after the App is first obtained (a date that a reinstall does not reset), while a measurement is in progress, or at any time after "Remove Ads" has been purchased.
Advertisements are served by Google. Their content is not selected, reviewed or endorsed by us. Consent and tracking choices are described in the Privacy Policy.
10Privacy
Our processing of personal data is described in the Linkalyst Privacy Policy, which forms part of your agreement with us.
Test reports are stored in the App's Documents folder on the device and are visible to you in the Files app. They are included in device backups where backup is enabled; the iOS settings determine whether backup occurs and allow the App to be excluded from it. Where you enable "Sync Reports", report files are instead stored in the App's iCloud Drive container and transferred between your devices by Apple's iCloud service under Apple's terms; we do not receive them. Deleting a synchronised report on one device deletes it on every device, and turning the setting off leaves the copies in iCloud Drive in place. Sharing a report is an action initiated by the user, and shared files are not redacted: they may contain IP addresses, host names, URLs, the service names, host names and TXT records of devices discovered on the local network, and, where the corresponding setting is enabled, Wi-Fi identifiers. The destination and recipients of a shared file are determined by the user.
11Third-party services
The App uses the third-party services identified in the Privacy Policy: Google (advertising and consent), Sentry (crash reports), TelemetryDeck (usage statistics), and FreeIPAPI (IP address information). Crash reports and usage statistics are enabled by default and may be disabled under Settings → Privacy; IP address lookup is disabled by default.
Use of the App is additionally subject to the terms applicable to any target selected for testing.
12Intellectual property
The App and its interface, text and artwork are owned by Entromoonic Ltd and are protected by intellectual property law. Open source components retain their respective licences, and the DB-IP attribution described in section 7 is preserved.
13Disclaimer and limitation of liability
The App is provided as is and as available, without warranties of any kind other than those that may not lawfully be excluded.
To the extent permitted by applicable law, our aggregate liability arising out of or in connection with the App is limited to the amount actually paid by you to us for it.
Nothing in these Terms excludes or limits liability that may not lawfully be excluded or limited, and nothing in these Terms affects the statutory rights of a consumer. Where you are a consumer in the European Union, the United Kingdom, or another jurisdiction conferring mandatory rights, those rights apply in full irrespective of any provision of these Terms.
14Changes to the Application, and termination
The features of the App are subject to change, and the App may be withdrawn from sale. Third-party services on which optional features depend, in particular FreeIPAPI, may change or cease to operate, in which case the corresponding features become unavailable.
We may terminate the licence granted under section 3 in the event of a material breach of section 4. You may terminate these Terms at any time by deleting the App.
15Minors
The App is a technical tool intended for a general audience. It is not directed at children, is not distributed in the App Store Kids Category, and is not intended for use by children under the age of 13, or under the age of 16 where local law establishes that age. Its App Store age rating applies.
16Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.
This provision does not deprive you of the protection afforded by the mandatory law of your country of residence. Where you are a consumer in the European Union or the United Kingdom, you retain the right to bring proceedings before the courts of your own country, and the mandatory consumer law of that country continues to apply.
17Language
These Terms are issued in English. Translations into Simplified Chinese, Japanese, French, German and Italian are provided for convenience. Where a translation differs in meaning from the English text, the English text prevails.
18Amendment
These Terms will be amended where the App changes. The version number and effective date stated at the head of this document identify the current text. Material changes will be notified within the App or in the App Store release notes before they take effect.
